By accessing or using the Fortis platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Nuelo CoLab Ltd ("Company", "we", "us", or "our").
Fortis provides a workforce operations platform including but not limited to: staff scheduling, time and attendance tracking, incident reporting, invoicing, client management, and site management. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

Fortis offers the following subscription plans:
All new accounts receive a 7-day free trial of the Professional plan. No credit card is required during the trial period. At the end of the trial, you must select a paid plan to continue using the Service.
Subscription fees are billed in advance on a monthly basis. Payment is due at the beginning of each billing period. We use Stripe for payment processing and do not store your credit card information on our servers.
We may change our pricing at any time. We will provide at least 30 days' notice of any material price increase. Your continued use of the Service after the effective date constitutes acceptance of the new pricing.
All payments are non-refundable except as required by applicable law. You may cancel your subscription at any time, but we do not provide refunds for partial billing periods.

We take data protection seriously. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
You are responsible for ensuring that any personal data you process through the Service (including employee data, client data, and incident data) is processed in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
The Service and its original content, features, and functionality are owned by Nuelo CoLab Ltd and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You retain ownership of any data you submit to the Service. By submitting data, you grant us a limited, non-exclusive licence to process, store, and display that data as necessary to provide the Service.
You are solely responsible for any content you upload, post, or transmit through the Service, including incident reports, shift data, and employee information. You represent that you have all necessary rights to any content you submit.
We reserve the right to remove or refuse to display any content that violates these Terms or is otherwise objectionable, but we have no obligation to monitor user content.
To the fullest extent permitted by law, Nuelo CoLab Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.
Our total liability to you for all claims arising out of or relating to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Nuelo CoLab Ltd and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
We may terminate or suspend your account immediately, without prior notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is disruptive to the Service.
You may terminate your account at any time by contacting us at hello@fortis.app. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall remain in effect.
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and, where appropriate, by sending a notification to the email address associated with your account. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. These Terms constitute the entire agreement between you and Nuelo CoLab Ltd regarding the Service and supersede any prior agreements.
